Terms of Use.

These Terms of Use ("Terms") govern your access to and use of mostfitbarber.com and related pages that link to these Terms (the "Site"). The Site is operated by Most Fit Barber, LLC ("Most Fit Barber," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Website Purpose

The Site provides general information about Most Fit Barber, the Most Fit Experience, Black Card, The Build, Private Society, production services, image and presence, fitness coaching, and relationship-driven concepts. Unless a separate written agreement says otherwise, the Site is promotional and informational. It is not a substitute for a direct consultation, confirmed appointment, signed service or membership agreement, professional advice, or the terms of any third-party platform.

2. Eligibility and Use by Minors

You must be legally capable of agreeing to these Terms. If you are under 18, use the Site and book services only with the involvement and permission of a parent or legal guardian.

3. Appointments, Payments, Cancellations, and Refunds

Appointments, availability, deposits, payments, cancellations, rescheduling, no-show charges, refunds, and related transactions may be handled through Google Appointment Schedules, Booksy for legacy records, or another identified third-party provider. The terms shown during booking and any policies communicated by Most Fit Barber govern the appointment transaction.

The Site itself does not guarantee availability or confirm an appointment. An appointment is confirmed only through the applicable booking process.

If a conflict exists between general information on the Site and a specific booking or service policy provided at the time of booking, the specific booking or service policy controls to the extent permitted by law.

Premium-offer pricing displayed on the Site is an invitation to apply or inquire, not an automatic acceptance or charge. Black Card, The Build, and Private Society require review and may require a separate signed agreement and payment terms before services or benefits begin. Do not rely on a submitted application as confirmation of acceptance, capacity, schedule, membership, or any result.

4. Grooming and Image Services

Results vary based on hair texture, condition, prior services, maintenance, individual preferences, and other factors. Photographs and examples are illustrative and do not guarantee identical results.

You are responsible for providing accurate information relevant to the requested service and for communicating allergies, sensitivities, injuries, or other concerns before a service begins.

5. Fitness and Wellness Content

Fitness, discipline, posture, habits, wellness content, and The Build coaching are general fitness and accountability services. They are not medical advice, diagnosis, treatment, physical therapy, licensed dietetic services, or a guarantee of health, physique, performance, or other results.

Consult a qualified professional before beginning or changing an exercise, nutrition, or health program, especially if you have an injury, medical condition, pregnancy, or other health concern. Stop an activity and seek appropriate assistance if you experience pain, dizziness, shortness of breath, or other concerning symptoms.

6. Network, Community, and Introductions

References to Private Society, a network, circle, community, trusted proximity, introductions, relationships, opportunities, providers, events, or access describe an application- and invitation-led relationship experience. They do not guarantee admission, membership, an introduction, access to any person or organization, employment, investment, partnership, transaction, event invitation, treatment, product, business outcome, or other result.

Any introduction is discretionary, may require consent from all parties, and may be declined or discontinued at any time. You are responsible for conducting your own diligence and obtaining independent legal, financial, medical, or other advice before acting on an introduction or opportunity.

7. Applications and Communications

Applications or inquiries submitted through the Site, Instagram, Google, Booksy, or another platform do not create a client, coaching, membership, partnership, fiduciary, employment, agency, joint-venture, or other special relationship. We may accept, decline, waitlist, or stop responding to an inquiry at our discretion, subject to applicable law and any separate written agreement.

Do not send confidential, privileged, detailed medical, financial, payment-card, government- identification, or other unnecessary sensitive information through Site forms or social-media direct messages. The Build form is intended only to flag limitations for a later fit discussion, not to collect medical history.

8. Acceptable Use

You may use the Site only for lawful, personal, and noncommercial purposes unless we provide written permission. You may not: interfere with or disrupt the Site; attempt unauthorized access; introduce malicious code; scrape or harvest data in violation of law or technical restrictions; impersonate another person; use the Site to harass, threaten, defraud, or violate rights; copy or exploit Site content beyond what the law permits; or use the Site in a way that could damage Most Fit Barber or others.

9. Intellectual Property

The Site and its text, design, graphics, photographs, videos, logos, trademarks, trade dress, and other content are owned by or licensed to Most Fit Barber, LLC and are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Site for its intended purpose.

No ownership right is transferred to you. You may not reproduce, distribute, modify, publicly display, sell, license, create derivative works from, or commercially exploit Site content without written permission, except as allowed by law.

10. Photos, Testimonials, and Third-Party Rights

Photographs or references to people, events, brands, or organizations do not necessarily imply endorsement, partnership, sponsorship, or affiliation. Rights in third-party names, marks, and content belong to their respective owners.

11. Third-Party Services and Links

The Site may use or link to Google Appointment Schedules, Booksy, Instagram, Cloudflare, Vercel, Supabase, Google Analytics, Meta, and other third-party services. We do not control and are not responsible for third-party content, policies, security, availability, transactions, or actions. Your use of a third-party service is governed by the third party's terms and privacy policy. A link does not necessarily imply endorsement or affiliation.

12. No Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." MOST FIT BARBER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, COMPLETE, OR ACCURATE, OR THAT ANY RESULT OR OPPORTUNITY WILL OCCUR.

Some jurisdictions do not allow certain warranty disclaimers, so portions of this section may not apply to you.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOST FIT BARBER, LLC AND ITS OWNERS, PERSONNEL, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OPPORTUNITIES, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATING TO THE SITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF MOST FIT BARBER FOR CLAIMS ARISING FROM OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DIRECTLY TO MOST FIT BARBER FOR THE SPECIFIC WEBSITE-RELATED MATTER GIVING RISE TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100).

This limitation does not exclude liability that cannot lawfully be excluded.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Most Fit Barber, LLC and its owners, personnel, contractors, and service providers from claims, losses, liabilities, damages, judgments, costs, and expenses, including reasonable attorneys' fees, arising from your unlawful or unauthorized use of the Site, your violation of these Terms, or your violation of another person's rights.

15. Suspension and Termination

We may suspend, restrict, or terminate access to the Site, remove content, or discontinue any Site feature at any time, with or without notice, subject to applicable law. Provisions that by their nature should survive termination will survive, including intellectual-property, disclaimer, limitation, indemnity, and dispute provisions.

16. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

17. Changes to the Site or These Terms

We may modify the Site and these Terms from time to time. Updated Terms will be posted with a revised effective date. Changes apply prospectively when posted unless a different date is stated. Your continued use of the Site after the effective date means you accept the updated Terms to the extent permitted by law.

18. Miscellaneous

If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and any specific policy presented during booking or service, constitute the applicable agreement concerning use of the Site. You may not assign these Terms without our written consent. We may assign them in connection with a business transaction or by operation of law.
